Attorney General Merrick Garland just revealed that he's not concerned about the knee surgery that Jack Smith underwent back in November, in the Netherlands, as a consequence of a bicycle accident. The Special Counsel for the Trump-related DOJ investigations remains in Europe, rebuilding flexibility and strength in his post-operative leg.
As Garland noted, Smith is not a scrambling attorney. He stays in the pocket and looks for his blockers to protect him when he launches a court filing deep downfield, or tries to juke the opposing attorneys with a bubble screen.
Garland added that Smith's post-operative progress has been even faster than the first predictions from the surgical staff.

"Special counsel Jack Smith hits ground running in Trump Jan. 6 investigation"
Looks like that cycling injury and subseqent knee surgery isn't going to be a problem for him. It's still early going, though. Will he hold up if he gets sacked?
"Since being appointed to head the DOJ investigation last month, Smith has already initiated a series of high-profile moves, such as requesting a judge to hold Trump in contempt for failing to comply with a subpoena...."
The night before Christmas is already nigh When wonder appears to my wide open eye, It’s a new report in the Washington Post Which I now present like a genial host.
This is a close-up look at the saga of the Mar-A-Lago documents investigation, from the very beginning of the dispute between the 45th President of the United States and the National Archives and Records Administration, all the way to The Night (except it was the day) They Raided Minsky's (except it was Mar-A-Lago) and finally the appointment of DOJ Special Counsel Jack L. Smith to oversee the federal government's highest profile investigations involving "45".
These are the nuances and "inside baseball" that no other media report can give you.
This is not for the casual or weekends-only Mar-A-Lago documents fan. This is for the fanatics that crave "Mar-A-Lago" on their plate three times a day.
"Skepticism before a search: Inside the Trump Mar-a-Lago documents investigation"

The FBI was initially reluctant to investigate Donald Trump’s possession of classified documents, and cautious when it did so
There's an audio (headphones) icon to listen instead of read. It says "20 minutes". The text is accompanied by photographs.
A [counterintelligence] review of the seized classified documents [from Mar-a-Lago] did not reveal an apparent financial motive for taking them. As best as investigators were able to determine in the months following the [FBI] search [at Mar-a-Lago], Trump’s motive in refusing to return the material seemed to be primarily ego, and petulance, according to people familiar with the matter.
In mid-November, at Mar-a-Lago, Trump formally announced he would run for president in 2024. Within days, [Attorney General Merrick] Garland took a step he had hoped to avoid, people familiar with his thinking said. He named a special counsel [Jack L. Smith] within the Justice Department to oversee the classified-documents investigation and the investigation of events leading up to Jan. 6, a probe that had expanded to examine the conduct of Trump and those in his immediate circle.
And now a word from Old Spice...

"'Fearless' Special Counsel Jack Smith arrives in Washington to lead Trump probes" Sarah N. Lynch for Reuters; January 4, 2023.

Jack Smith, the U.S. special counsel named to investigate Republican former President Donald Trump, has a reputation for winning tough cases against war criminals, mobsters and crooked police officers.
Behind the scenes, however, Smith's former colleagues say he is just as tenacious in his pursuit to get criminal charges dropped for the innocent as he is to win convictions against the guilty.
When Smith isn't busy competing as a triathlete in Ironman races, they said, he is working as a dogged investigator who is open-minded and not afraid to pursue the truth.
"If the case is prosecutable, he will do it," said Mark Lesko, an attorney at Greenberg Traurig LLP who worked with Smith when both were prosecutors at the U.S. Attorney's Office in New York City's Brooklyn. "He is fearless."
Smith recently returned to the United States after working from The Hague in the Netherlands since November while recovering from knee surgery following a biking accident, a person familiar with the matter, speaking on condition of anonymity, said on Wednesday.
Nevada’s most populous county has provided the U.S. Justice Department special counsel with correspondence that shows lawyers for then-President Donald Trump raising concerns about the integrity of the 2020 voting process that were later deemed baseless. Documents obtained by The Associated Press also show Trump's allies demanded information about workers who were tasked with counting the votes, a request the Clark County registrar sought to delay out of fear for the workers’ safety. The correspondence was provided by the county to Jack Smith, the special counsel tasked with investigating efforts by Trump and his allies to overturn the election results, in response to a subpoena.
"How come the Biden "Prosecutor" is a nice guy, very friendly with Democrats and RINOS alike, close to Christopher Wray, & pretty much liked & known by everybody, while my "Prosecutor" is a Radical Left Trump HATING Lunatic, whose wife & family get a perfect "10" for spewing Trump HATE, & whose "friends" are the most evil, angry, & disgusting Marxists & Communists in & around Government?" Lumpy asked. "They are GRILLING innocent people in Grand Juries for hours, all to "get Trump." These are Sick Thugs!"

These Truth Social messages from @realDonaldTrump speak a Truth that is serene and inviolable... a Truth that resides far beyond the realm of classified documents and special prosecutors.

Hey, I just thought I'd resurrect this 14-page "beauty" for old time's sake.

Special counsel Jack Smith's office presented sufficient evidence to establish that former President Donald Trump committed a crime through his attorneys, a U.S. district judge ruled Friday night, a source briefed on the proceedings confirmed to NBC News on Wednesday.
The full segment is just over 9 minutes. It aired last night (March 23) on MSNBC's "Morning Joe", although some here might prefer to say that it erred last night on MSNBC. In addition to the Morning Joe regulars, it features former federal prosecutor Andrew Weissmann and NBC News justice and intelligence correspondent Ken Dilanian.
Andrew Weissmann, Professor of Practice at New York University School of Law, has a "bio" page with email contact information, in case anyone wants to critique his contribution here on MSNBC's Morning Joe: https://its.law.nyu.edu/fac...raphy&personid=39254

I duplicated the text (verbatim) that was with the MSNBC broadcast segment on YouTube.
It should say "Special Counsel Jack Smith's office presented sufficient evidence to establish the likelihood that former President Donald Trump committed a crime through [with the witting or unwitting cooperation of] his [Trump's] attorneys..."
This is why the judge approved the Special Counsel's request for invoking the crime-fraud exception to allow for piercing of attorney-client privilege to secure grand jury testimony and evidence from lawyer Evan Corcoran, who has been representing the former President in this matter.
I was fully aware of this, from the beginning. My focus was on documenting the YouTube video—not on correcting that text. That's why I duplicated the text verbatim, without correcting it. To document the YouTube video.
If I had to do it over again, I guess I would be inclined to correct that text, instead of reproducing it verbatim. I didn't anticipate any reaction over something that seemed so obvious. Looking back on it with the benefit of hindsight, after having the experience, I would want to anticipate this reaction, if I were in that same moment again, but the natural flow of events in the space-time continuum has already relegated that moment to the past, and so I cannot be in that same moment again.

This is a good "read" on the Mar-a-Lago documents case. It was published shortly after the FBI "raid". I'm not sure if I haven't already posted it in this long-running thread, but even so, it's such a good article it deserves to be posted again.

Attorney Evan Corcoran recused himself from representing former President Donald Trump in the special counsel investigation related to the Mar-a-Lago documents given that he testified for investigators, two sources familiar with the matter told CNN.
Corcoran’s exit, which was first reported by The Washington Post, was an expected development after special counsel Jack Smith’s office forced him to testify without the shield of attorney-client privilege in front of the grand jury and prosecutors accused Trump of using his attorney to advance a crime.
Despite recusing himself from the Mar-a-Lago probe weeks ago, Corcoran continues to represent Trump on other matters, including the January 6, 2021, investigation. He appeared in court on behalf of the former president for sealed proceedings related to that part of Smith’s probe just days after his testimony in the Mar-a-Lago documents case. . . .

Wow... I didn't see this coming!
I have no idea who "peggy" was. I'd have to try to figure that out by searching online.
My only reason for posting that Jackson Pollock canvas was because it was my reaction to the "art" that was posted by Wichita, of the "rump" embracing Hillary Clinton. (I guess that's Hillary Clinton?)
