80 year old man decided to turn left on a green right in front of me, locked up the brakes (G-DAMN ABS!!!) and hit him with my '07 Ford Fusion P/S front(he got hit D/S Rear.
Friend I know has a towing business, his dad came and picked it up.... The car looks totalled, windshield smashed from the hood, engine looks intact but the surrounding front frame is distroyed, cant open p/s front door, car starts and dies, i'll grab pics tomorrow - cop at the scene making the report says he failed to yield to me.
Any advice?

Sorry to hear about this. And yes it sounds totaled. It doesn't take much to total newer cars. And maybe you will be able to buy a new Fusion. Ford should be damn near giving them away at this point, and the newer lights look pretty nice.
So how are you doing? I bet you will be sore in the morning. I would suggest going to the doctor if you haven't already.

Yes, the cop filled out a form with both insurance's information, My friend is a Ford salesman, just got done talking to him on the phone(among a bunch of other people) I bought the car from him 2.5 years ago.

Getting really sore, I called the ER, was 4+ hours backed up already they were super busy so I'm going to wait until tommorrow and talk Pontiackid86 into driving me there unless my wife gets back from work early.

Take photos of the site asap including skid marks, traffic light sequences, gouges and anything of interest including the woman in the bikini selling hot dogs on the sidewalk (if any). try to get some of the scenery in the photos so the length of skidmarks can be determined later if necessary. In other words, assuming it is a busy intersection, stand on the side of the road and take a photo where the skid mark starts, but make sure a light pole, bench or other landmark is visible in the photo so the length of the mark can be determined at a later time, if necessary, after they faded away.

Wish I could remember if he had his lights on, turn signal etc.. it was getting dark and I always have my lights on day or night.
Depending on what is left of his car, light operation can be determined by looking at the lamps. If there is any question in your mind, tell your insurance company asap so they can arrange to have the other car properly inspected before it is fixed.

He is gona win this. in PA if you dont yield to another persons right of way is almost the equivalnt of committing a mortal sin plus the intersection he was at is a huge pain in the nads i see either andrew not at falt or a no fault accident if ins companys argue.

He was hit in the rear/p/s tire area, actually hit right at his tire and it flew off wonder what his big hurry was, I know he had the lights on after the accident, probably realized he better.

If you are making a left, then it is YOUR responsibility to ensure you can do it safely and clear the intersection.......if ya screw it up, then its points off the licence, and your fault, and you (or your insurance) pays.

Is PA a no-fault state? If not, the insurance companies will get together and decide what percentage of the accident was your fault. No kidding, even if you actually were totally blameless, your insurance company will agree that you were partially at fault to avoid a court date. Since you will probably be found to be at least 10% responsible, don’t plan on receiving a 100% recovery for your loss.

Sounds like he was almost thru his turn when you so unceremoniuosly struck him in the right rear. How long were braking your skid marks?
Are you implying that Andrew hit him on purpose? And there would be very little for skid marks with ABS. The other car did not yield the right of way to the oncoming lane before they made their turn.

X2 The person going straight in this state always has the right of way to someone turning, The older gentelmen should have been out of andrews path before andrew got into the intersection or he should not have went at all. Just like the rule of thumb with a stop sign if the person driving down the road has to hit there breaks for the person leaving the stop sign the person pulled out when they shouldent have.
Not to mention the intersection this happend at is a very odd intersection. I avoid it whenever I can.

I think he was trying to beat me out, or plainly couldnt see/judge when to go and right before I got to the intersection he cruised right around the center barrier w/o stopping/slowing
and Yes, he was ok at the scene and refused an ambulance (sorry to sound selfish in my earlier posts as I already knew this information)

Ouch Andrew, sucks to be you? Although, at least you outta get a new car out of the deal...should be ruled as his fault since he made the left in front of you and you hit him. My stepdad had this happen a few years back at an intersection much like this in his work truck. He got a nice new truck from the deal, and it was ruled no fault on his part.
So, uh...what are you doing with the front seats from the focus?
