I spent the entire day doing stuff, cleaning the car out of all my possessions, got a rental car, went to the ER and got X-Rays, thankfully nothing except muscle strains from the airbag/seatbelt, got the police report ($15 wtf?) faxed police report, talked to both insurance co's, my cell phone died at 3:30pm I used it so much today (3 day charge if no calls etc) driving today I was jumpy, super cauious.

Well Andrew, thank God you're ok. Judging from the pictures it looks like the accident could've been a lot worse. As for being jumpy, yep, that will happen for a while. I got t-boned in my '88 Beretta on the drivers side by a Bronco II (my fault), and thankfully nobody was injured, but my car was toast, and the Bronco wasn't driveable. I was jumpy for a while. It is super nerve wracking being that jumpy, I remember.
Been in a couple wrecks too... the jumpiness does wear off after a while, but never entirely which is actually a good thing
Too bad your car is smashed up but at least nobody is really hurt and you should come out on top with a fresh car, despite messing with the paperwork in the mean time. As for the car being totaled by the insurance, definitely. It looks like the frame is bent back to the PS door frame but its a bit hard to tell if its just a dent from Grandpa's car spinning and hitting the door. However, you would be amazed at how well a clever body shop can pull a mess like that back out with a come-along, some chain, and a couple stout trees

two days of paperwork, alot of BS and the other Ins Co is in the initial stages of giving me the run around, the body shop guy just told me the adjuster is coming out to only take pictures and something else(forget what he said), which he says is what they do when they are going to drag thier feet, it was originally assigned to one person, but x-fered to someone else because I had muscle strains, and neither of them had gotten to the file yet late this morning, I already did the leg work by getting the police report faxed to to my insurance, the body shop in case its needed, both locations of the other ins. co. the report says unit 1(other driver): Improper/Careless Turning.

IIRC, insurance companies typically total a car if the cost to repair the damage exceeds 50% of the value of the car. So it sounds like it will probably be totaled and probably sold to a rebuilder as I think it could be put back together by a bored DIY'er.
In the mean time, keep annoying the ins. co. by calling them every couple days to check on your claim. Don't let them drag their feet for too long *but* it does take some time to get everything sorted out.

My insurance co gave me an estimate of 10k today, the other insurance co has yet to give me a value, which will be my next move tomorrow morning. 50% of the value of the car is 8k and they're not totalling it?

If I hadn't hit my brakes I might have missed him also, I got grandpa's ins adjuster to tell me a few things, first he claims he was sitting at the light stopped(green - yield to oncoming traffic) which #1 is a lie, I saw him speed towards the intersection and round the median which is when I realized he was not going to stop and I locked the brakes up, he also said he was going 10mph which I know was BS, he rounded that median like his @ss was on fire, he also changed his story from what he told the cops (green light) to what he said to the adjuster that the light turned yellow and he went, he also stated that he was stopped at the intersection because there was people in front of me in the left lane going straight which is another lie, there was NOBODY near me for 1/4 mile in front or back. I can only imagine the different things that caused him to make an error in judgement, 80 years old... maybe he didnt wear his driving glasses? delayed reaction caused him to misjudge my speed? I had headlights on, always do so.... OTHERS CAN SEE ME because the Car is Black and sometimes can blend in with the road, I know when I drive and see someone with lights on, it takes a split second longer to determine the speed the vech is traveling at, maybe thats what happened?!?!

Not smart on Grandpa's behalf to be changing his story, espeically after its in writing on the cop's report.
They dont give a $hit, really - i'm going to measure my skidmark and stuff tomorrow, i've been talking to safety people at work (I'm a UPS Driver) @45mph, you travel 67 feet a second, 1 second minimum for the signal to travel from your eyes to your brain to your foot, move your foot to apply brakes so immediatly you've traveled 67 feet before your foot hits the brake. (the formula is MPH x 1.5 = x feet/sec)
My Insurance is paying up front now and going after the others for reinbursement, but i'm going to be on them all like a fly on $hit so this doesnt come back on me for whatever reasons, I want this 100% not my fault not that BS 80/20 thats allowed here in PA.
And, I told the others insurance (because I have an open medical claim) about the back pain thats gotten worse, worked thurs/fri this week because the bills have to be payed and boss cannot cover me (low manpower)
oh, I did get some good information, if things are found during the teardown/rebuild that were not known(hidden damage) they CAN increase the amount for the repair, this was something I was worried about in my head.

I can't believe they aren't going to total it. if they are trying to place part blame on you i would go full force on pain and suffering suit for your injuries. take as much Physical Therapy for your injuries as possible to help you heal right and as fast as possible. Makes you feel great when someone hits you because of bad driving and you are left holding a huge mess. Good luck to you, hope everything works out in your favor!

Thanks Monkey, the body shop thats doing it is top notch, i've been in contact with the owner throughout the whole ordeal, i'm actually considering changing the color of the car from black to a REALLY sweet looking Red, the interior is black with red stitching and such. I figure wtf, they're going to have to paint half the car anyway might as well paint it something I Like (liked the black but the black ford fusions are a dime a dozen now) Pontiackid86 had some ideas about the red he was thinking about, I really liked that color.

He cant sue for paint and suffering. i dunno about other statets but we have a full and limited tort option with insurance if you only have limited you can onle sue for certan things like lost work time and such and its only somthing you can take up in a small clames court.
