I am responding to this: ************** House Democrats in their letter say they are “very disappointed” that the ATF delayed the rule. The proposal, they say, is true to the spirit of the Law Enforcement Officers Protection Act, which Congress passed in 1986 to ensure that officers do “not face extreme safety risk from firearm technology.” ************** The law enforcement they refer to is the tyranny that happens as there is less and less of a free state. Law enforcement and the troops that were out after the Katrina Hurricane are the problem, not the solution based on evolving behavior.
Yup. Dems are PISSED that the ATF didn't further restrict law abiding citizens' Second Amendment rights. Even if I believed their "protecting Law Enforcement" talking point, until you can show there's a statistically significant number of incidents of AR15 pistols using M855 cartridges in the commission of crimes, I'm calling
Now is the time to push for legislation to drastically curtail and explicitly state what the ATF can and cannot do. Some have called for disbanding the ATF altogether, but I disagree. Have an agency with the responsibility to regulate firearms, and very specifically detail what they can and cannot do. Otherwise, the Executive Branch and Justice Department will just do whatever the hell they want in the absence of legislation preventing them doing it. Clearly they don't believe the 2nd Amendment imposes any limits on what restrictions government can place on firearms.
Rep. Eliot Engel (D-N.Y.) is pushing the Armor Piercing Bullets Act following the Obama administration’s decision earlier this week to withdraw a controversial proposal that would restrict 5.56 mm projectiles for M855 cartridges commonly used in AR-15 rifles.
“Armor-piercing rounds like green tips should only be in the hands of military personnel or police officers, period,” Engel said. “There is absolutely no compelling argument to be made for anyone else to have access to them.”
“But the out-of-touch gun industry lobby is fighting tooth and nail to keep cop-killing ammunition on the streets. We need to speak up on behalf of our police officers and say ‘stop the madness, ’” he added.
The fact that M855 is *not* "armor piercing" under the legal definition, and that virtually ALL centerfire rifle cartridges will penetrate soft body armor doesn't seem to matter. Facts don't matter. The Constitution doesn't matter. All that matters to Democrats is disarming Americans, however they can.
What is on their backs? All future attempts at lies, half-truths, and any other governmental abuse of the 2nd Amendment?
Which part of "shall not be infringed" do you not understand?
The part that you don't understand that the ATF has the legal authority to review all ammo to determine it to be banned as illegal under a legislation that the Second Amendment hating Republicans and Ronald Reagan signed into law back in the 80's.
All the ATF did was asked for comments about the M855 ammo to determine it if should be considered illegal. But they have the authority to do so, because the Republicans let them have that authority, not Obama, but Ronald Reagan.

In my post above I did not dispute they currently have authority to do this. I am disputing the lies and half truths used in an attempt to make illegal something that is by the BATFE's definition not illegal.
The broader question of whether the original law to which you refer is constitutional has not been challenged to my knowledge. I wish the BATFE would be disbanded and their responsibility handed over to existing agencies. Then I wish Congress would stop stepping on the 2nd Amendment.
