It might vary somewhat by jurisdiction. I still think the tree owner is responsible for damage from it. Its also illegal to trim someone elses tree if its hanging on your property unless its an obstruction or hazard to you. The two insurance companies should be able to figure out who is responsible according to your local law. Like I said, its also no problem taking the owner to court over the damages. Make sure you have photos and estimates. Having the latest survey to prove where the boat and tree are also couldnt hurt.

Sure, that is first step, let your insurance company bleed his dry. But if they dont, then there are other steps to be taken.

There was damage so that means action, not advice. File the claim, and see if they pay. If not, then take other actions, up to taking it out of his hide if necessary.

You destroy my property or injure my dog, and refuse to make it right, yes i would. And if i was coming you wouldn't have a chance to fight back as i wouldn't be waving a flag. Trust me on that.

( now im not saying if you are just being an ass ill drive over and start a fight, but as mentioned above i will yell at you over the fence, and most likely call the cops.. i was talking about actual harm being done and refusal to own up to it. I wont let you ( figuratively i know you are not my neighbor ) get away with that.

Its a good thing we are not neighbours. We would either get along very well, or there WOULD be bloodshed within a week. I am guessing the very 1st time you "yelled over the fence" about the noise of power tools, or a bit of wood/ fiberglass dust flaoting around, I would end up shuving a power tool up your ass PDQ. I wasn't making a threat, or even implying one. I was only saying that if you knew me personally you wouldn't do it, as making a statement like was in the image is totally invalid ( and stupid ), thus you wouldn't make it.

I certainly hope you don't need to "explain it a different way." Given your tendency towards violence that could end badly for me.
