I guess they couldn't wait to get their grubby little paws on this money. What will happen if the supreme court decides it is constitutional? Where will they get the money they stole from it then?

The congress is doing the same thing they did with the social security funds.. If there is money in some pot, congress will confiscate the money for some other use leaving behind a worthless IOU. Those that take the money should be made to pay it back from their pockets and not from the taxpayers.
