Well he broke the rules of his bail. He contacted one of the other defendants and they caught him because his lines are tapped....duh. My box of popcorn has more brains than this idiot. Judge revolked his bail, police took custody in Miami and hauling him back to Nevada right now.

Some folks never learn. I gave him more credit than that but I see that he and Britney have alot in common.

I think it may be more arrogance than anything else. Still hasn't learned that he's not completely untouchable. I wonder if he actually thinks that, if they find new evidence in the Brown/Goldman murders, they can't haul his butt back into court. =\

http://www.cnn.com/2008/CRI...pson.bail/index.html

LAS VEGAS, Nevada (AP) -- O.J. Simpson was taken into custody in Florida on allegations that he violated terms of his bail by trying to get in touch with a co-defendant in a Las Vegas armed robbery case, according to court documents.

O.J. Simpson faces trial on 12 counts, including robbery and conspiracy.

Simpson, 60, is to go before a Nevada judge on Wednesday at the request of Clark County District Attorney David Roger.

The prosecutor filed a motion Friday to revoke Simpson's bail, a court clerk said.

Court documents obtained by CNN say Simpson allegedly tried to reach co-defendant Clarence Stewart though a bail bondsman. That was a violation of the terms of his release.

Authorities say they have a copy of a voicemail Simpson left for Stewart, the court documents say.

Simpson was freed September 19 on $125,000 bail following his arrest on allegations he and several friends burst into a Las Vegas hotel room and robbed two sports memorabilia dealers at gunpoint.

Simpson's lawyer, Yale Galanter, did not return phone messages seeking comment.

Simpson has pleaded not guilty to 12 criminal counts in connection with what prosecutors contend was an armed robbery.

In November, a judge ordered the former football great and two co-defendants to stand trial.

The counts include conspiracy, kidnapping, robbery, burglary, coercion and assault with a deadly weapon.

Prosecutors allege Simpson and five other men burst into a room at the Palace Station Hotel, held two memorabilia dealers -- Alfred Beardsley and Bruce Fromong -- against their will and flashed at least one gun while removing items.

Simpson said he was merely taking back items that belonged to him, but one of the two alleged victims described it as a "military-style invasion."

Three other men initially charged along with Simpson in the incident -- Walter Alexander, Charles Cashmore and Michael McClinton -- testified against him during a preliminary hearing under the terms of a plea agreement with prosecutors

They can't. He was tried and acquitted. Even if he confessed, he's not prosecutable again. It's called Double Jeopardy, is guaranteed that it won't be used by the 5th amendment to the Constitution. In more general terms, it's called "res judicata" and if they ever attempt to try him again for those murders, or a substantially similar charge like assault with a deadly weapon, manslaughter, etc., all the has to do is plead "autrefois acquit ", or "previously acquitted" and if shown that he was, he can't be tried again.

the trial was so long ago that i can't remember the actual charges. if they were going for 1st degree murder originally they couldn't get him for manslaughter? well if there was some outstanding evidence?

what about perjury or interfering with a police investigation? i bet they could find something, probably wouldn't put him away for very long.

maybe OJ and Brittany can get a reality tv show together? something like the honeymooners...Brit: oh juice, i got high and lost track of the kids again! OJ: Brit, one of these days i'm gonna cut you up!

No. There are some exceptions, but very few. For instance, IF he had bribed the judge, or tampered with the jury, it's possible to retry him, but IIRC they'd have to use the old evidence, nothing new. If the trial had ended in a mistrial, which sometimes prosecutors attempt to do intentionally if they're losing for just this reason, it can not stop being re-tried for the same offense. If a judge sets aside a jury verdict, then in some cases the accused can be re-tried. There's a reason for this "technicality" and the US isn't the only one that has it.

Let's say that you, being a thorn in the government's side, decides to make a real nuisance of yourself. You make an enemy of someone, say a prosecutor or the attorney general. Even though you haven't done anything illegal, he files charges against you for something he says you did. You spend a year in court. You are acquitted. The day you walk out of court, he files the same charges again, claiming "new" evidence. You spend a year in court. You are acquitted. The day you walk out of court, he files the same charges again, claiming more "new" evidence. You spend a year in court.

Do I need to go on?

It is an old, time honored method of harassment by government and, in fact, even though it's in the Constitution, some states still did this until the late 60's when the supreme court ruled that the fifth amendment applied to the states as well as the federal government.

Maybe. But don't hold your breath. Besides, I think this time OJ might not slink by since he appears to have lost some IQ points from the last time.
