ok here is the deal it can be in 3rd and if im not giving it any gas it will be fine but the more gas i give it the louder it grinds/ whines every other gear is fine but it seams this is getting worse yesterday is would grind on and off now its anytime im giving it gas in 3rd could it be anything other than a ground up 3rd gear?

Did you check the shift linkage adjustment?

Is it perhaps not fully in 3rd because the shifter linkage has gotten as far as it will travel and the linkage is holding it out a bit or putting pressure on the slider?

well also i must add my trans leaks oil and after that sound came in yesterday i checked my lube level and it was pretty much empty and dont know how long it has been like that took a whole bottle to fill it up

i really need to figure out soon if this would mean 3rd gear is bad cause there is a 4 speed on ebay i will buy if it does but the auction ends tomorrow morn

So that is the download of the Haynes manual - it covers more than one year.

and then under TRANSMISSION (Chapter 7) -

MANUAL TRANSMISSION ( Part A of Chapter 7)

In subsection 5 (7A-5) on Page 151 of 259 it details the shifter cable adjustment

that is the gear itself time for transmission rebuild or replace it.
