Wow but they are slow
can you continue to use your PayPal account in the meantime? Or do they force you to wait for them? I've read some horror stories about what can happen when PayPal takes over a dispute.

No delay on my end as I have used it with no trouble since. They probably have allot of issues to look over being as big as they are. Rick

Ok, Pay Pal has said the word. If Rick returns the steering wheel and pays for the shipping back to me I am to give a full refund. I'm ok with this but, I did call them to find out how they came up with this decision. A word to all PayPal told me they will always side with the buyer if a question comes up. Because I stated this fits a Fiero even though I never said it was from a Fiero. So I asked him if I was selling a master cylinder and it turned up it was a rebuilt Auto Zone unit I would have lost it? They said yes.. So, after about a half hour on the phone I came up with you beter put some form of "as is" or "all sales are final" wording on your listing as I would have won this claim with Rick if I did as Pay Pal stated to me. Rick no bad feelings and I see we both could have done it better. So we all learned something from this and I'm just glad the shipping wasn't like $100 bucks for both of us. It would be nice if those who slammed red marks on me took them back. I am a collector and from a collectors point of view is where I was coming from. My lawyer friends were correct as stated they were not and many other rotten remarks but the red bar is still there. Neat how some think and then are probably even madder now that they were wrong. I see my bar got redder and not sure how it went from 64 to 63. Oh Well just more proof the Ratings bar is not a good thing. Rick

Well, honestly I still don't think he was in the wrong just because PayPal sided with you. I did not think they would, but I understand their reasoning for doing so.
You return the item, he gives the money back. Fine, simple enough.
But I still don't believe you were cheated or wronged. The situation was blown out of proportion, it wasn't as you expected and he refused to take it back. I don't think a seller should be forced to take back an item and I understand his initial non-willingness to do so.
I also understand your interpretation of his ad. While more information could have been given, the information there was not wrong. You defined a new Fiero steering wheel differently than he did. You expected a new original wheel, while he had a new Fiero wheel from FieroStore.
I'll admit I had you negged and am dropping it.

Rick, if things don't go your way with this, I'd agree with avengador—sell it on Ebay and I bet you can get your money back.
Edit to add: that's a beautiful car you have there![This message has been edited by timwdegner (edited 08-26-2007).]

I agree.. Just because PayPal says something don't make it law. That is why so many people complain about. The seller's description was exactly what you go and I would be pi$$ed if a buyer jacked me because he didn't understand my description and didn't ask questions.
Still, I didn't neg you over it because negs shouldn't be given because of character flaws, but only because of people being abusive. I admit it got close when you didn't get the response you wanted from the general public here, but you did stay mostly under the line. Sorry I can't help you get rid of some of that red.

I can assure you that your lawyer friends are not correct. Since they are lawyers, they could make an argument, but that is a long way from being correct. Do you think, even for a minute, that the PayPal representative who made the decision in the instant matter, attended law school? I rather doubt it. These people are clerical staff.
By way of example, a good friend bought what was supposed to be a new brand name external hard drive from an ebay seller with over 24000 sales. It turns out that the drive was a refurbashed internal drive that had been repackaged into an external case. My friend complained to PayPal who refused to make a decision for months, despite the fact that there were numerous complaints from others as well, and the fact that there had been at least two web sites created where victims of this seller could congregate. See, e.g. http://www.motherfathercockerspaniel.com/
All of the above is just part of the reason I will not use PayPal (exacerbated by their oppressive, one sided contract with users).
Despite what your lawyer friends have said, I doubt that you would have had any realistic chance before any trier of fact based upon the factual scenario that you presented to us.

Another good example
I guess these eBay sellers are in for lots of PayPal disputes! They don't say anywhere in their ad that these are aftermarket seat covers. The ad just says 'Pontiac Fiero 1984-1988 *FULL SET* Seat Covers'. I guess they just expect people to be smart enough to know or smart enough to ask. And they have every right to expect that.[This message has been edited by Songman (edited 08-26-2007).]
