Conspiracy to use violence to gain entry into the Capitol Building by fighting with police officers, forcing open locked entrance doors and climbing through broken out windows (after breaking the windows), invade the working areas of the House and Senate and prevent Congress from certifying Joseph Robinette Biden, Jr., as the 46th President of the United States.

It was planned even before the Oath Keepers, Proud Boys and Three Percenters came to Washington, DC, to gather at the Stop The Steal rally in front of the White House on January 6. The conspirators planned their tactics--their tactical deployment in "stacks"--and used encrypted online communications to keep their secrets from the FBI and other law enforcement agencies. They used encrypted radio communications on January 6 as they implemented their assault on the Capitol Building and the police that were defending it.

They calculated with 100 percent confidence that a large number of the other Stop The Steal demonstrators would follow their lead, helping them to overwhelm the police, who were vastly outnumbered and ill prepared for the situation.

There was indeed an insurrection. There were skirmishes in places like Portland, Seattle and Kenosha. It culminated in a clandestine operation in November 2020. There was no war, only surrender.

There was even actual, provable, coordinated, "CONSPIRACY to interfere with government proceedings" (the very same thing a few of the Capitol rioters are being charged with)

As of today, NOBODY has been charged with Threatening government officials of the United States under 18 U.S.C. § 871 or 18 U.S. Code § 351 or 18 U.S. Code § 115 or any local statute as a result of the MOSTLY PEACEFUL events of January 6, 2021

Outside of your fevered imagination, there are ZERO statutes under federal law that define "clear and present danger"

Additionally, 10 CFR § 1047.7 - (Use of deadly force) similarly does not define or suggest "clear and present danger" but IT DOES explicitly lay out that Michael Byrd, broke the law when he murdered Ashli Babbitt.
