Just to close the books on this little escapade, the Judge issued a 'walk' (weak attempt at humor), not a 'strike'. Click Here I thought dropping two days off of his sentence for 'good behavior' was particularly meaningful. But you'll all be relieved to know (from other accounts not included here), that the DA treated this case, with injuries, 'just like any other case' that rates a Misdemeanor. My confidence in equal-justice-under-the-law has been restored.

One point to quibble: was his blood alcohol level 0.082 at the Time of Drawing or the Time of the Accident? Since they waited several hours to draw, I thought I read somewhere, his body would have been metabolizing the booze but the folks in the lab know how to calculate for that.

With some luck, next time the alcoholic will run a red light and get squashed by a big rig. Hopefully Nancy and Gavin are in the car with him. It'll be a 3 for 1 sale.
