Hillary got away with it. She walked classified documents (which means illegally removed) and loaded them onto her personal unsecured server at home. Anthony the Weiner and is bimbo wife (neither with high security clearances) had them too. Wasn't the server just a way to provide the docs to foreign governments for payments to her Clinton Foundation payoff scheme by allowing the unsecured server to be hacked by those governments?
Biden might not be as powerful as a Clinton though. Maybe he knew years ago he had dementia coming on and figured he'd serve no time by the time it caught up with him and before he would go to trial?
