If they were to admit that it's because the show is declining in ratings, he could sue for wrongful termination and then get all of the money through May of 2026... which would be another 15 million dollars.

Ok, if you can believe me when I'm saying that... looking at this from purely a legal standpoint, I don't think Kimmel fights this. He still has a contract for another ABC television show, and they use him routinely for other shows and special events. So, suing ABC would likely upend that... and to a degree, they likely have already talked to him and expressed this to him.
From a legal perspective, I don't know how it is in Canada, but in the United States, tort law does not need to rise to the level or burden of proof for the plaintiff, in order to get restitution. Meaning that... if it was a criminal case, you'd have to prove motive and that a crime had been committed. In tort law, the burden is far lower, you just have to show that the preponderance of facts stacks up to support your claim. So, he would have that going for him as the plaintiff (with ABC being the tortfeasor / defendant).
What Jimmy would have to show is that they breached his contract because the show was losing money, rather than what he specifically said (which if I'm trying to be unbiased, is not new, left-leaning shows always say that exact same thing, every time). He could theoretically subpoena e-mails, chat messages, etc., but more than likely, if this was in fact the reason they cancelled him (losing money), they (the board / CEOs) would know better, and the companies likely would have talked over the phone. If they had records, that would be admissible evidence. He could also try to use "circumstantial" evidence, which is relevant, but does not entirely point to fault, merely helps build a narrative. Circumstantial evidence would be the discussions that they were not planning on renewing his contract after May 2026, Stephen Colbert was cancelled for low ratings, Conan O'Brien was cancelled for low ratings, etc. He could also use analyst data (from news sources) that have been saying the same thing that I said from the beginning.
All of that would be "breach of contract" ... I can assume, but since his contract isn't public, we can't know. There's a general "Conduct Clause," and this was what was cited as having been violated by Jimmy that led to ABC cancelling him. The problem with a conduct clause is that they are generally written in a vague manner. This is done intentionally so as to give companies a slight upper-hand. It would be an uphill battle, and he would likely lose the tort case... and on top of that, they would likely drop him from other shows as well (as I mentioned, he's still employed with one other full time show, and gets used regularly on ABC).

Last I read, it's tomorrow - Tuesday - night. I suspect he'll keep it low key, unless he wants his "comeback" to be very short-lived.
I also suspect he'll have a bumper crop of morons lined up to be part of the "festivities" - studio audience, not guests. Who knows who the hell he'll have as guests. But you couldn't pay me to be anywhere near the place.

While I am disappointed in Disney's decision, maybe, just maybe Kimmel will figure out how to not piss off more than half a nation. I don't expect an apology, I'd be very surprised should that occur but, maybe I'll be surprised. I fully expect his ratings to skyrocket for a short time but how long will that last?
Ratings have been dropping. I wouldn't put it past them to have staged this all in an attempt to start all this drama. That victim card must be getting pretty thin by now.
It's being reported that Sinclair will still be preempting the Kimmel show. I'm pretty sure the Kimmel show will have high ratings tonight, how long will it last. Disney has stated that they've held several "thoughtful" conversations with Kimmel. I'm sure there was some "advice" provided by Disney. We'll learn how effective that conversation was soon. Kimmel's fan base may increase for a short time but, how long will that last.
Edited: Nexstar has joined Sinclair in preempting Kimmel's return. This brings happiness to my heart to know some out there stand for decency. Lying comedians should not be allowed on the airwaves. I miss Johnny Carson and Jay Leno, great hosts and pure comedy.

I don't think people care anywhere near as much about this as you do. You made this original post, got all upset because you felt like freedom of speech was being curtailed... we said it had nothing to do with Trump or the Government, and more to do with the channel itself. There was a lot of back and forth on here... but at the end of the day, no one really cares except people on the left who feel as though they were slighted. I would be a little surprised if there's a single right-leaning person on this forum who cares at all what happens to the Jimmy Kimmel show.
