Yup. The "blame the victim" mentality has been spreading for a loonngggg time.

I'm just waiting for suicide bombers to start suing innocent bystanders for being in the way and causing the shrapnel to miss the intended target. Maybe start charging them with theft of high-velocity material.

The only way I see that working is if the person is texting insanely and repeatedly in an attempt to cause an accident, and someone dies. Then they could be an accessory to murder since there was intent.

But if a Millennial is texting another Millennial, and they both know one of them is driving, there's no way the non-driver is going to get charged because the driver gets in an accident.

Driver should be responsible in any case of them calling, texting, surfing or receiving a text behind the wheel. Most states that have an anti texting law I know of say NO HANDHELD device whatsoever in drivers hand period. If your too dumb to use hands free, you should have your azz sued off everytime you hit anything. Just about any car made now has a hands free system from the factory, so there is absolutely no need to have anything in your hands except the steering wheel. Id even be happy with insurance companies canceling anyone ticketed for holding a device and driving, along with MANDATORY jail time. Police usually have your insurance info when they do a stop now, so easy to send a notification. Do like DUIs and take their car or tag away.

Morons didnt take it as advice, then just told not to, then made it against the law with fines, and yet thousands still do it everyday. They need to start harsh penalties.
