I think this fits the "Play stupid games, win stupid prizes" mold quite well.

Yup.

Smith, who works nights, was asleep when the tree crew contracted by a utility to trim branches near power lines, woke him up at about 10 a.m. Tuesday.
He went outside shirtless and yelled at the workers to leave. When he's not wearing a shirt, the tattoo looks like a gun tucked into his waistband.

All utilities have right to do maintenance etc without notice to anyone. Many utilities will sent out notice for schedule maintenance but most just ignore that. Many states got hit w/ snow/ice damage and now many utilities are trimming trees.
DA could still charge him even when police didn't at the time. Anything said to News could bite later.

Good thing that tattoo didn't scare one of the cops. Cops have killed for less.

"I got plans today. I didn't want to get shot," Smith reportedly said

So it's ok if he gets shot on his days off?
Good thing he didn't have this tattoo....

I think its kind of funny, especially since police didnt shoot him.

Yes they have the right to access to service what they need to. What would the police charge him with ? Last I knew, its not a crime to yell at people on your property. He didnt do anything to them. Charge him with scaring utility workers...? According to the report, he didnt even curse at them. I know some weird places have laws against using obsene lanquage in public. but thats only a $10-$25 ticket IF they can even make that stick.

They didn't taze him? I'm surprised. Every place I've lived, cops use the tazer on you and ask questions later. If I just get pulled over on the street for something, I'm afraid I'm gonna get zapped, even before they say "Sir, do you know why I tazed you?"
